I would think Cross-Charegeability is automatic. I mean if one spouse is birth country India/China and one is ROW, I would think cross charegeability is automatic but then again not a 100% sure.
Oh no - Its not automatic. You would think there would be a better way than write on cover sheet in BOLD but even though its in their own law, it is not easy to get it applied (especially with TSC).

1) Peoplesoft Enterprise ERP package is damn popular among HRMS software user world. Peoplesoft (before Oracle took over them) were earning major money/client on that package.
2) Peoplesoft Enterpriseone(This was JDEdwards earlier version of Oneworld ERP). Enterpriseone has strong Finance module which may helps you to grow in future in your professional career. You can be a functional consultant in finance or HRMS or both.
You can join any of several consulting company who are in Peoplesoft/ORacle/JDEdwards ERP business and for which they need MBA kind of background for their functional requirement at their client site. Hi,
Well, Bush has delivered his address on the immigration subject. Unless I am missing something, not a word was said about the Legal Immigration or the H1Bs. All the focus was on the illegal immigrants and the border enforcement.
Does that mean that the Legal ones like us are in the backburner? Would the Senate and the house focus only on the illegals and give them the path to citizenship, leaving those who played by the rules, in the lurch? What kind of justice is this in the "Land of Justice"?
I hope the senators and the representatives are sensible and leave the provisions for the EBs in the proposed bill, alone.
Hoping for the best.

My employer filed I-140 in June but I did not get any approval yet so my employer ask me to wait until it approved then file for I-485?
Are there chances that if I file I-485 it would get rejected?

Our lawyer Company has decided to file the AOS application in July
I work for a big 5 Software company & our lawyer Littler Global had taken a stand on July that they will not file our AOS application after the June VB was revoked/amended on July 2nd.
Surprisingly , today we have received a mail from them that that keeping in view our best interest they have decided to file our AOS case in July regardless of CIS receipting them.
Wanted to share this information as it may be helpful for you folks too ...

As long as your sister is complying with the terms of her B-1 admission, she is entitled to begin work for the new employer as soon as that employer files an H-1 petition requesting a change of status on her behalf. Pay stubs from her original H employer should not be required. The language quoted below is from a Nov. 2000 USCIS Q&A:
"Q10: Who is eligible to use the H1B "portability" provisions?
A10: The portability provisions allow a nonimmigrant alien previously issued an H-1B visa or otherwise accorded H-1B status to begin working for a new H-1B employer as soon as the new employer files an H-1B petition for the alien. Previously, aliens in this situation had to await INS approval before commencing the new H-1B employment. These provisions apply to H-1B petitions filed "before, on, or after" the date of enactment, so all aliens who meet this definition can begin using the portability provisions.
Q11: Are there any other limitations on the portability provisions?
A11: An alien must have been lawfully admitted into the United States. The new employer must have filed a "non-frivolous" petition while the alien was in a period of stay authorized by the Attorney General. My primary tip is patience... By very early, I mean at or just after sunrise... Early's no problem, I don't sleep anyway. :p I'll work on my patience ;)
I've also had great success with a trick Don Bevis shared. You can get thin bamboo sticks... I always carry two of them with me and stick them in the ground so that they apply slight pressure to the plant stem... It doesn't always work, but it does so often enough that it's worth hauling the sticks around... I remember Don's bamboo stick tip now that you remind me. I'll go to the nursury today...
These days I make heavy use of my 5-in-1 disk for diffusion and reflection... but Kevin Sadler talked me into spending more money to get a quality product and I haven't regretted it... Kevin's suggestion of using a quality reflector is a good idea, I'll go the camera store after the nursury...
As for shooting technique, a tripod is a must... and hang the camera upside down... and frequently use mirror lock up... GaryI use a manfrotto 3001BPRO tripod, which allows you to put the camera all the way onto the ground, and even position the center column horizontally, but I use a pan-tilt head that's not too flexible (and I bent it the other day :(). I'll look at ball heads while I'm at the camera store... I never thought of hanging the camera upside down! I'll try that. Great tip. As i had indicated earlier, I spoke with my employer, he cannot do anything in terms of lobbying - but has agreed to do things. He will donate to IV and he will write a letter stating that small businesses like ours need to be able to fully utilize the capabilities of the employers...and it helps to have the green card.
Not sure who the letter needs to be addressed to, any suggestions would be helpful.

Hi, This is my first post here and I need some guidance regarding new-H1 under FY2010 quota.
--One of my friend told me about this company in Chicago who is doing H-1s and apparently the quota is not over yet. I am in India and
--Is it advisable to get my H01 filed at this time?
--What if the USCIS asks client letters? They said, the company will take care of it if that happens -- is that even legal to say that?
--What is the probably the CAP will be met by that time they file my H-1 in the next 2 weeks? And am not sure if the attorney returns the money in that case.

If you file 485 based on your previous approved 140, you are compelled to go back to your previous employer when your GC is approved.
So the options you have are:
1. File 485 based on previously approved 140. If approved within 180 days, go back to previous employer otherwise use AC21 to change employer to current employer. This presumes that your former employer is willing to continue support of your GC.
2. You could file 485 based on unapproved 140 since concurrent filing is still allowed.
The choice is yours.

Plus, H1B is debated and decided upon (pro-H1B's are quite happy as-is), EB has not been debated at all.
And when they vote, they may delete the H1B from the cap-removal and retain the GC, which will be just fine for us. We should support this amendment. It might go through after some changes.

Just now my lawyer called to tell that she got all my receipts , filed on july 2nd but my wifes application was rejected for "insufficient filing fees", I had put in a single check for $745 , how can this be, it was both in the same fedex packet, she says it is some "mailroom error", so she sent back the application with a letter and my receipt copy to accept. My app also had a $745 check and that was receipted,
