    Agreed. $5000 is about the same amount a single student paid to TVU, the diploma mill. This used to be the price 1 employee paid a fraud DCC for processing a Green card.

    Is it still not clear for you? eb-dependents are NOT eligible for F2A.
    We have to follow the regulation when law is not clear and the regulation (CFR22) mentioned specifically that eb-dependents are eligble for EB-category. Regulations and interpretations are there for a reason, and it has to be followed when law is not clear.

    I agree that INA doesnt specifically says that, but at the same time INA specifically rules out eb-dependents from F2A also. To be eligible for F2A you should be dependent of a permanent resident "at the time of application".

    You should probably stream line your effort to not count eb-dependents in any visa-numbers (since neither the regulation or law is clear on that part).

    You are still under a mis-concept that every word and sentence has to be quoted in "INA", and can ignore all official regulations and interpretations.

    Guys,

    VISA BULLETIN FOR JUNE 2009 sets back EB2 priority back to 01JAN00.

    Some thing needs to be done. The easist will be not counting ebdependents in ebquota. This should be very easy. There is no INA law linking ebquota with ebdependents.

    I need IV Core help for this.

    I agree, another argument in support is that if the situation of skilled legal immigrants does not improve many of them may consider other options like Canada, Australia, UK, NZ or even going back home. The employers most likely will outsource the jobs to other countries and once that happens that position is permanently gone from US. Hoewver, if an immigrant is working here the position is still here in US and can be taken by a citizen or a resident here if the immigrant workers leaves the job position.

    This myth has never been successfully countered in the media or any other PR or lobbying channel by the legal immigration crowd.

    The standard line amounts to this:

    We are highly skilled we are legal and we are stuck and dont deserve this.
    This is not good PR. Nobody cares about this.. it will get us nowhere..

    We need to have a standard message apart from all other humint crap..

    1) legals cannot undercut US jobseekers because of strict labor laws. Employers are paying a premium in wages as well as legal fees to retain their legal alien workforce. IT would be foolhardy of them to go through the hassle if local talent was easily available.

    2) legals are in most cases paying taxes for which they may never realize the benifits like social security.

    We need to let it be known in a firm polite manner that
    1) we are giving more than we are getting and are not free loaders
    2) we are not harming or displacing anyone.

    I dont think this can be perceived as tryng to distance ourselves from undocumented workers. There are rare moments when the media does focus on legal immigrants as a group lets make the most of it.

    All 140K GCs are available on Oct 1. However, dates were not current in 2005 and 2006. I think that current dates do not depend on available GCs.

    Looks like current dates depend on # submitted AOS's. USCIS is saying that on Jul 2 it has submitted AOS's that exhaust submitted AOS quota.
    the availability of dates are determined by DOS after consulting with labor department and USCIS. if the they determine that enough labor applications are pending to fill the entire quota for the year they issue the cut off dates accordingly.
    India is allocated only 10,000 visas in all categories(EB1+EB2+EB3). dates will never be current, given around 700K applicants were ready to file. out of the 700K I imagine atleast 35% will be from india, which translate to around 250K applicants from india who are ready to file I-485, india is given 10K , u can do the math and find out for yourself how much time it will take for the dates to be current.

    AFAIK all 485 filings have to be sent to NSC. Also, does one need to attach the original I-140 approval with I-485 or a copy of it will suffice?

    Attorney got the receipts today FINALLYYYYYYYYYYY.... No update on my EAD/AP but spouse EAD "ordered"... One Hurdle cleared....

    My Info: 140 TSC Approved 2006. 485/EAD/AP JUl 2nd NSC at 1025AM JBARRETT..RECEIPTS received 9/12/07..

    Think Once again,

    Processing application based on Priority dates which is applicable to Any Employement (EB1, EB2, EB3) or Even family categories, with respect to Quota for that catagories..

    Again as Somebody mentioned Earlier, its not going to get solved in 2-3 Months, So this will be helpful only from Futuristic purpose.

    Its Vision problem, But this can't be solved by Lawsuites, It needs discussions, Negotiations and Communication, By Who have access to USCIS representative. In a Nutshell IV or AILA Kind of group, need to bring on their agenda, if they think its in Best interest for everybody.

    Simply put i am used to standing in queue to Buy Coffe, and somebody gets priority I feel i've been bypassed.


    Agree with you completely... and I would like to add one more point is this unnecessary classification of EB-1, EB-2 and EB-3... we are all highly skilled among our respective fields.. and I don't think this classification does any justice... but I very well know this wont be solved in 2-3 days... so no use talking abt it.. i guess

    I thought of going back after getting citizenship, but that would be another 8-9 years at the least. I would miss the big ride in India. When I went there(Coimbatore, Tamil Nadu) 3 years ago, I did not like it that much. But I see a big change in the last 3 years. Infrastructure is improving. Few of my friends have already gone back and are pretty happy over there.

    I am from Hyderabad, l left that city in 1999 to do my MS, got my MS, switched a couple of jobs as i thought career growth / job satisfaction was more important than filing a GC, finally my present company filed my GC in 2009 (PD 2009), I am fed up of this laborious process, not everyone can take it, and I am one of them, and as I get older, I am getting more conservative and I find it difficult to adjust here. I am visiting India this year, if everything works out, I will be heading back, even with all the complaints about India, it still is my country of birth, and there is a saying, "Janani Janma bhoomishya swargadapi gariyasi", translated, Mother and motherland are superior to the Heaven.

    as per the attorney, the case history of employers who won using non competes in the court are very rare unless the law suit is agiainst key personnel and court gets convinced by the legitemate business interest. If the employer still chooses to fight, he has got more to loose than me because of non payments of wages also being involved here. since non compete has been used just to escape the wages, courts wil be more hard on the employer and will consider it as threat rather than genuine.

    Thats good news. I think the attorney I met represents more of employers and so very reluctant on mine. I believe I still have hopes, I will look for a good attorney again to get mine reviewed.

    While your story is interesting, but I beg to differ again, because, immigration is not something which would be discussed in the Congress for the first time, if we are successfull in bringing something. Each and every single lawmaker in this country understand immigration to the extent that you may not even start to guess...People who oppose us have been putting their restrictive bills again and again so they are going to continue doing that despite of us do something or sleep, do you think Numbersusa wait for us to do something, their anti.... mill will keep churning.

    Sometimes you have to see the other perspective rather than just defending a point of view.
    Now is not a good time for immigrants. The EB5 investor visa, which is a no brainer in this economy has been kicked on like a can for 6 mths at a time, congressmen that are pro- immigration are laying low. Anti-immigrant forces are gearing up for a big assault in coming weeks, the American public is unsympathetic given their own issues. Against this backdrop why would we launch such an effort. Basically now is the time to play Defense not Offense. Do all you can to hang on to your job, keep your savings liquid. Wait for any opportunities to arise, and wait for the storm to pass.
    After the great depression, this country virtually shut down immigration for the next few decades. Likewise they slowed it down in the early 80s and again in the early 90s. Right about now, no change is a good thing IMHO, as bad as that sounds, as change will not be in your favor.

    thanks for responding...any contradicting/second opinions? What is the exemption towards - both filing for 485 and processing of 485 too, right? Isn't it an exemption from the EB quota?
    The exemption is just to file, the processing will however take what ever the regular processing time would at that point of time. I am sure that there is no provision to expedite the "processing" of I145.

    (disclaimer: Like everyone else here, I am very dissapointed. Hence the negative mood)

    I am wondering how we ended up here. We have been doing this campaign for so long, we have now hired a lobbying firm, and we've met, called, emailed and faxed so many senators etc. How come this bill completely ignored, and in fact in some senses, hurt us?

    I have seen posts about lawmakers being stupid, out-of-touch etc but I think these posts are mostly facetious. I feel troubled by the fact that in spite of numerous efforts the lawmakers decided to ignore us - and if this was India I would have attributed this to the fact that in us they don't (yet) have a vote bank.

    Please take this post in a positive way and as a stimulus for some soul searching - why did we end up in this situation?

    Guys,

    I just got my H1B Extension approved (8th year extension).
    Original H1B was valid until Sept 2008. Changed companies after 180 days(of I485 application) and applied for H1 transfer and extension for 3 years via new company. Finally got it approved after 3 months for 3 years(until May 2011).

    As much as all of us on this board would like to get our GCs, remember that GC is just a means to an end, it is not the end itself. Dont make the GC so important that not getting it starts "depressing" you.



    if you see life as a series of choices and actions, then the lack of GC inhibits a lot of choices and actions.

    how badly you wish to change career for example, varies among individuals. but one should not forget that life is finite number of years, and the system here wants to eat all your productive years by dangling the GC carrot.

    as sufferers of this ordeal, i believe it is our duty to inform the young and innocent who are not yet in this mess, about the future that awaits them.

    mind you i am not discouraging anyone from coming to the US.. that is a decision that must be made by the individual.... just making sure the rules and realities of the game are known to people before they come here.
